Defensa de Gette solicitó el cese de prisión pero fue denegado por la fiscalía
El presunto asesino de Daniel Casermeiro seguirá en la cárcel.
Los abogados de Gerardo Luis Gette (59), el único imputado y detenido por el homicidio del ginecólogo Daniel Casermeiro (61) solicitaron el cese de prisión alegando que lleva dos años en la cárcel sin condena, lo que fue denegado por la fiscalía interviniente que pidió un año de prórroga en el proceso a la Cámara del Criminal y Correccional planteando que aún faltan resultados de pericias para resolver la causa. En tanto, la Cámara aún no resolvió.
Gette está acusado de "homicidio agravado por el uso de arma de fuego y alevosía" y permanece alojado en la Unidad Penitenciaria Nº 7 desde el 27 de diciembre de 2019. En caso de condena, le cabría una sola pena: la prisión perpetua.
Sus defensores, José Valverde y Fernando Martini, sostienen que "de que ninguna persona puede estar detenida más de dos años sin una sentencia". Se amparan en el Código Procesal Penal que establece que "transcurridos dos años, se puede solicitar la libertad o el cese de la prisión preventiva".
Por su parte, el fiscal de Delitos Complejos, Bernardo Alberione, atribuyó el pedido de prórroga a la demora que tuvo la investigación "por pedido de la propia defensa de Gette y por resultados de prueba que aún se está diligenciando. A ello hay que sumarle el tiempo que insumió la apelación que llevaron adelante los defensores ante la Cámara del Crimen de la ciudad de Bell Ville, que es la actúa como Cámara de Acusación de San Francisco".
"Estimamos que en menos de un año estaremos en condiciones de resolver la causa", dijo Alberione a LA VOZ DE SAN JUSTO.
La autopsia determinó que el médico había sido ejecutado por la espalda con un balazo calibre 22. El disparo fue en la nuca. Fue un asesinato a traición. Había desaparecido el 19 de diciembre de 2019 y su cuerpo sin vida apareció una semana después al costado de la vieja ruta a Luxardo, en un campo de maíz.
