A una semana de un fallo polémico: ¿por qué Carlos Fuentes no está preso?
"Preso libre". El exfuncionario municipal fue condenado con cárcel, pero por ahora no estará tras las rejas. Un especialista en derecho penal explica porqué, una pregunta que se hace gran parte de la sociedad que manifestó su indignación por el fallo judicial.
Pasó una semana y la condena por el caso Carlos Esteban Fuentes solo trajo indignación. Luego del juicio hubo una marcha y escrache a la casa del exfuncionario municipal, que fue condenado a 7 años de cárcel por el abuso sexual de una de sus hijas y una amiga de ésta.
Sin embargo, aunque la sentencia es condenatoria, Fuentes sigue en libertad hasta que el fallo quede firme, y en la sociedad ante esto solo hay una pregunta: ¿por qué? La respuesta está en el principio de inocencia establecido en el artículo 18 de la Constitución Nacional y que es ratificado en todo el ordenamiento jurídico argentino.
Otros piensan en la edad de Fuentes, que tiene 69 años, y recuerdan que a los 70 muchas personas que han sido condenadas siguen cumpliendo su pena bajo el régimen de prisión domiciliaria. Entonces la indignación vuelve y se transforma en un "no va a ir nunca preso" o "va a estar en su casa".
Mientras tanto, la ley y todo el sistema judicial no son suficientes para aliviar la sensación de impotencia de las víctimas, sus familiares y gran parte de la sociedad que siguen pidiendo la prisión efectiva del exdirector de Cultura y periodista.
Consultado por LA VOZ DE SAN JUSTO, el abogado penalista y docente universitario de Derecho Penal, Rubén Caffaratta, explicó qué relevancia tiene esta sentencia de primera instancia; cómo se puede determinar si una persona debe estar detenida o no y también la forma en que funciona la modalidad de prisión domiciliaria.
Cabe destacar que el abogado lo hizo en general y no pensando solo en el caso Fuentes.
La gravedad del delito no amerita la prisión
Durante la Investigación Penal Preparatoria (IPP) y habiendo uno o varios imputados, siempre las personas tienen el derecho de ser asistidos técnicamente por un abogado.
En ocasiones, sucede que durante la IPP se dicta la prisión preventiva y el imputado llega al juicio estando detenido, y hay causas en las que esto no sucede. Dirimir esto para un fiscal que conduce la IPP no es algo que se da automáticamente ni aun porque el delito que se le imputa sea grave.
"La gravedad del delito por sí misma no autoriza que el fiscal prive a alguien de la libertad. Debe haber indicios de peligro procesal, para eso además de la sospecha debe haber indicios que se dará a la fuga o entorpecerá la investigación", indicó Caffaratta.
Si esto no sucede, se privilegia el principio de inocencia y el fiscal seguirá investigando con la persona estando en libertad. Es decir, "mientras no exista peligro procesal, la persona sospechada de cometer un delito debe permanecer en libertad".
Ahora bien, al realizarse el juicio y aunque se imponga una sentencia condenatoria no hace que automáticamente se lo prive de la libertad.
Víctimas y familiares expresaron su indignación y brinca tras conocer el viernes pasado la sentencia
"La sentencia condenatoria es un hecho que amerita que se lo prive de la libertad y el fiscal puede pedir que se dicte esa prisión. Pero también puede ocurrir que aun condenada la persona, se mantenga a derecho independientemente de la gravedad del hecho", afirmó el entrevistado.
Estar a derecho significa que el acusado no representa peligro procesal y que aun condenado, puede seguir estando en libertad hasta que la sentencia quede firme y se agote la instancia de recursos.
En el caso de "Cacho" Fuentes, él nunca estuvo detenido, ni durante la IPP ni tampoco ahora que se dictó la sentencia de primera instancia donde lo condenaron a 7 años de prisión.

Fuentes recurrirá la sentencia
Aunque Fuentes fue condenado por la Cámara Criminal y Correccional de San Francisco, esta solo fue la primera instancia. A él lo asiste el derecho de recurrir a un tribunal superior.
Esto no le quita valor a lo dictaminado por el tribunal porque "los jueces consideraron que los hechos, o algunos, por los que Fuentes venía acusado sí existieron".
El abogado puede interponer un recurso de casación y entonces la Sala Penal del Tribunal Superior de Justicia (TSJ) decide si ratifica la condena "porque hay elementos suficientes y los hechos existieron o en su caso, debe dejarse sin efecto porque fue mal condenado", se explayó Caffaratta.
Estas dos hipótesis son las que pueden darse en una segunda instancia y "aun así, el abogado todavía puede recurrir ante la Corte Suprema de Justicia de la Nación e interponer el recurso extraordinario".
Ante esas posibilidades, Caffaratta aseveró que "no hay una sentencia que haya adquirido autoridad de cosa juzgada" y la persona sigue siendo amparada por el principio de inocencia. "No la hay acá porque hay instancias superiores donde se puede acudir, enfatizó.
Cuando se conoció la sentencia
condenatoria para Fuentes, pocos minutos después su defensor aseguró que
recurrirá ante el TSJ pidiendo un recurso de casación para que el fallo se
revea.
Caffaratta esbozó cómo actúa la Sala
Penal en estos casos: "A partir del fallo Casal de la Corte los jueces tienen
la obligación de rever todas las cuestiones que plantea el defensor, toda la
prueba y el fondo de la cuestión".
El abogado continuó diciendo: "Ahí decide sí son válidas las pruebas y llevan a la conclusión de que cometió el hecho del que se lo acusa, sino son suficientes y no dan certeza, no puede ratificar la pena".

¿Prisión domiciliaria?
Otras de las especulaciones que exaspera a los familiares de las víctimas es que Fuentes cumpla una prisión domiciliaria teniendo en cuenta su avanzada edad. Esta situación también fue motivo de una aclaración por parte del penalista, siempre desde una perspectiva general teniendo en cuenta que cualquier persona condenada puede solicitarla.
"Hay una falsa creencia que cuando la persona cumple 70 años automáticamente se le otorga, pero actualmente hay casos en distintos tribunales del país donde se les ha negado", indicó Caffaratta.
Lo cierto es que la prisión domiciliaria puede ser pedida por una persona que tiene 70 años cumplidos como mínimo (Fuentes tiene 69) pero no es la única situación que debe ocurrir para que se le otorgue.
En este sentido, amplió el concepto: "También puede pedirla alguien que tiene enfermedad terminal o en su caso, una madre que tiene hijos a cargo. En cualquier caso se otorga cuando se cumplen determinados requisitos, hay que ver otras cuestiones también por parte del juez de Ejecución Penal y debe mediar un pedido de la defensa demostrando que hay otras motivaciones para otorgarla".
La sentencia
Por mayoría, Fuentes fue hallado culpable de los delitos " abuso sexual gravemente ultrajante" en perjuicio de una de sus hijas - la mayor de las denunciantes- y "abuso sexual simple" en perjuicio de la amiga.
A juicio del tribunal y de los jurados escabinos, por unanimidad, se lo absolvió de los delitos de "abuso sexual agravado sin acceso carnal y promoción a la corrupción de menores" y "abuso sexual con acceso carnal" en perjuicio de la menor de sus hijas.
Este fallo cerró la etapa de juzgamiento de primera instancia y el exfuncionario municipal a través de su defensor recurrirá ante el TSJ para interponer el recurso de casación y que el fallo se revise.
Hay que aclarar que Fuentes nunca estuvo preso durante el proceso, ni tampoco se le ordenó esto al finalizar el juicio porque su situación no generaba peligro procesal alguno y durante la investigación tampoco motivó este dictamen. Solo podría quedar detenido cuando quede firme la sentencia.
